HERO Act Prevention Plan Implementation No Longer Required

​The New York State Department of Labor last week announced that employers in the state are no longer required to implement their airborne infectious disease exposure prevention plans. The plans, required by the New York State HERO Act, must be designed to help prevent the spread of infectious diseases in the workplace. ​When the Delta variant of the coronavirus that causes COVID-19 swept through the country late last summer, the state Department of Health designated ​the disease as "a highly contagious communicable disease that presents a serious risk of harm to the public health.​" That declaration triggered the requirement for all employers to implement their plans.
